Effective date: September 21, 2026.
When you submit a form on this website, we collect the information you enter (name, contact details, and, where you provide them, a property address and the details of your inquiry) along with basic technical information such as your IP address, browser, and the page you submitted from. We use this information to look up the sale you asked about and to respond to you. We do not sell it to third parties.
We use limited analytics (a self-hosted Umami instance and, where enabled, Google Tag Manager) to understand how visitors use this website. These tools do not receive the contents of the forms.
If you sign a written agreement with us, the information needed to prepare and file your claim is shared with the clerk of court and, where the case requires it, with the Florida counsel we work with, as described in that agreement.
To request a copy of the information we have about you, or to ask that it be deleted, contact us using the details on the contact page.
Important disclosures
- 01 Surplus Funds USA, LLC is not a law firm and does not provide legal advice or legal services.
- 02 You may be able to claim surplus funds yourself, directly from the clerk of court, at no cost. You do not need Surplus Funds USA or any other company to file a claim.
- 03 We are paid only from funds actually recovered, under a written agreement you sign before anything is filed. If nothing is recovered, you owe nothing.
- 04 Nothing on this site guarantees that surplus funds exist for any property, that a claim will be approved, or when a clerk will disburse funds.
- 05 Claim deadlines apply under Florida law (foreclosure surplus: Fla. Stat. § 45.032 and § 45.033; tax deed surplus: Fla. Stat. § 197.582). Missing a deadline may forfeit a claim.
- 06 Consider independent legal advice. Florida legal aid organizations may be able to help at no cost.
